Service Content

ImgToVid AI provides AI-powered creative services, including but not limited to:

• Text to Image and AI Image Generation
• Image to Video and Text to Video
• Video to Video and AI Video Editing
• AI Effects, AI Photo Editor, and other AI Tools
• Prompt generation and related creative features
• Generation history, public sharing, and Create Similar features where available
• Subscription plans, credit packs, and other paid features

Service Changes

We may modify, suspend, or discontinue the Service (or any part of it) at any time. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Permitted Use

ImgToVid AI grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for lawful purposes in accordance with these Terms.

Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, crawlers, scrapers) to access the Website or Service without permission
• Interfere with or disrupt the Service or connected servers and networks
• Circumvent, disable, or interfere with security features of the Service
• Use the Service for any unlawful, fraudulent, or abusive purpose

6.1 Platform Intellectual Property

All intellectual property rights in the Website, the Service, and content provided by ImgToVid AI (including software, text, graphics, logos, and trademarks) are owned by ImgToVid AI or its licensors. Except as expressly stated in these Terms, you receive no rights or licenses in these materials.

6.2 User Input Content

• Users and/or original rights holders retain ownership and intellectual property rights in content they input.
• Use of the Service does not alter or transfer such rights.
• You represent and warrant that you have the necessary rights to all materials you upload or input.

6.3 Generated Content

• As between ImgToVid AI and the user, rights, ownership, and interest in generated content belong to the user, subject to applicable law and your subscription plan.
• Ownership of AI-generated content is still evolving legally; rules may change as laws develop.
• Except for the limited license below, ImgToVid AI does not claim independent intellectual property ownership in user-generated content.
• You are solely responsible for all content generated using the Service.

6.4 Limited License Granted to Platform

By submitting user content to the Service, you grant ImgToVid AI a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, distribute, and display such content solely to operate, maintain, and improve the Service; optimize products and services; conduct branding and legitimate marketing relating to the Service; and display, organize, tag, feature, and promote content that you make public through the Service.

If you do not make content public, this license applies only as needed to operate the Service for your private use (for example, processing your inputs and storing your outputs in your account).

6.5 Commercial Use

Paid plans may include commercial usage rights as described on our Pricing page (https://www.imgtovid.ai/pricing). Commercial use does not guarantee that generated content is free from third-party intellectual property claims. You remain responsible for verifying rights before commercial use.

6.6 User Feedback

Feedback, suggestions, or ideas you provide about the Service may be used by ImgToVid AI without compensation to you, to the extent permitted by law.

6.7 Community Gallery and Public Content

Where the Service allows public sharing, you may choose to make images, videos, prompts, or related metadata public. By making content public, you grant ImgToVid AI and other users limited licenses as needed to host, display, tag, recommend, and enable Create Similar or similar discovery features within the Service, as further described in our Content Policy.

You represent that you have all rights necessary to make content public and that public content complies with our Content Policy. Do not publish sensitive personal or confidential information in public posts.

No Warranty on Output

• We do not guarantee the accuracy, completeness, legality, or suitability of AI-generated content.
• AI output may contain errors, biases, or inaccuracies.
• AI output does not represent the views or positions of ImgToVid AI.

Third-Party Rights

• We do not guarantee that generated content does not infringe third-party intellectual property or other rights.
• AI output may unintentionally resemble copyrighted works or trademarks.
• You are responsible for verifying potential rights issues before use, especially for commercial purposes.

User Responsibility

You are solely responsible for your use of generated content. ImgToVid AI is not liable for third-party claims arising from your use of generated content.

8.1 Payment Finality

Payments for subscriptions and credit purchases are subject to our refund rules in Section 9 and our Refund and Fraud Policy (https://www.imgtovid.ai/refund-and-fraud-policy). Except where a refund applies or as required by law, payments are final once the refund eligibility window has passed, the subscription credit usage threshold is exceeded, or the purchase is a non-refundable one-time credit pack.

8.2 Subscriptions and Auto-Renewal

ImgToVid AI offers monthly and annual subscription plans and credit packs. Subscriptions renew automatically at the end of each billing cycle unless cancelled in accordance with our policies. You may cancel through your account subscription management page or by emailing [email protected]. To avoid future charges, cancel at least seven (7) days before your renewal date.

8.3 Plan Selection

Please review your selected plan (monthly, annual, or credit pack) carefully at checkout. Annual plans may include discounts and longer commitment periods.

8.4 Credits

Many features consume credits. Credit usage, rollover, expiration, and plan limits are described on our Pricing page (https://www.imgtovid.ai/pricing) and may change with notice. Failed generations may be refunded credits according to platform rules.

Our refund rules are set out in this Section and in our dedicated Refund and Fraud Policy (https://www.imgtovid.ai/refund-and-fraud-policy). In summary:

9.1 Subscription Refund Eligibility

• Refund requests apply only to subscription plan charges and must be submitted within three (3) calendar days of purchase.
• If you have used more than 50 subscription credits from that purchase, you are not eligible for a refund.
• One-time credit pack (add-on) purchases are non-refundable.

9.2 Processing

Approved refunds may be subject to a processing fee not exceeding six percent (6%) of the initial payment and will be returned to your original payment method. To request a refund, email [email protected] with your account email, order reference, purchase date, and reason for the request.

9.3 Non-Refundable Situations

• Requests submitted after the 3-day window or after exceeding the subscription credit usage threshold
• One-time credit pack purchases
• Subjective dissatisfaction with AI-generated results
• Chargebacks without first contacting support

Prohibited conduct includes using stolen payment methods, exploiting system vulnerabilities, malicious refund requests, creating multiple accounts to abuse promotions, and reselling unauthorized account access. We may suspend or terminate accounts and report serious misconduct to relevant authorities.

The Service may contain links to third-party websites or use third-party providers (payment processors, cloud providers, AI model providers). We do not control and are not responsible for third-party content, privacy practices, or terms.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law.

To the maximum extent permitted by law, ImgToVid AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claims arising from your use of the Service shall not exceed the total fees you paid to ImgToVid AI in the twelve (12) months before the claim arose.

You agree to indemnify and hold harmless ImgToVid AI and its officers, directors, employees, and agents from claims arising from your use of the Service, violation of these Terms, infringement of third-party rights, or content you upload or generate.

You may terminate your account by following instructions on the Website or contacting us. We may suspend or terminate your account for any reason, including violation of these Terms. Upon termination, licenses granted to you end immediately and you must cease all use of the Service.

These Terms are governed by the laws of the Republic of Singapore, without regard to conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts of the Republic of Singapore, unless mandatory consumer protection laws in your jurisdiction require otherwise. Before initiating formal proceedings, you agree to contact [email protected] to attempt good-faith resolution.

• Entire Agreement: These Terms, together with the Privacy Policy, Content Policy, and Refund and Fraud Policy, constitute the entire agreement regarding the Service.
• Severability: If any provision is invalid or unenforceable, the remaining provisions remain in effect.
• Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction.

We may modify these Terms at any time. Material changes will be posted on the Website and may be communicated by email or in-service notice. Continued use after changes take effect constitutes acceptance unless prohibited by law.
